Governance crisis cannot be treated by old formula of changing faces

Commenting on the melting state of the economy, a reputed economic analyst stated how the “deplorable state of governance” was responsible for the “mismanagement of public goods”. Luckily, he also reiterated how such accountability was best undertaken through an election. A common misnomer that plagues public discourse relates to how “governance” is viewed as the job of an elected government and that the state and the government are interchangeable entities. It is important to note that the state of Pakistan — post-colonial, encroached and bitten by its non-state offspring — remains the dominant power centre and most elected governments have been at subordinate to these permanent interests.

The most glaring manifestation of this reality came about when the federal government in the memo-case (concerning the alleged treasonous act of authoring a memo addressed to the US against Pakistan’s security establishment) submitted before the Supreme Court that it had no control over the operations of the military and the premier spy agency — the Inter Services Intelligence (ISI). This has been said before as well in other judicial proceedings but not so directly. Everyone knew that but the government’s admission makes it clear that ‘constitutional governance’ is but a pipedream in the land of the pure. Without prejudice to any institution, this has been the case for decades and is not going to change overnight.

A new state within the state may have emerged. During the hearing of the same case, an honourbale judge of the Supreme Court remarked in his obiter dicta that the Judiciary was not answerable to anyone but the ‘people’. This statement defies logic as judges are not ‘elected’ by the people; and they are also servants of the state, paid by the taxpayers who are represented by the Parliament. These developments have prompted a beleaguered government and its Prime Minister to announce that Parliament was supreme and that there ‘states within states’ cannot be tolerated.

Leaving aside the torrential decade of 1970s, the evolution of an autonomous power centre within the state apparatus in the form of the intelligence agencies is a well-recognised fact. A martial state since 1950s has been a player in the global power games in the region; and the redirection of state unlike India was almost inevitable. The 2008 elections were, therefore, a transitional moment and during transitions from military to civilian rule, power is shared and not exercised by the elected officials. The addition of another power-centre i.e. the Judiciary is a recent and in its nascent stage of development. Pakistan’s beleaguered civilian government has entered into the final round of its survival game. This is not a new ‘game’ as the transition to democracy has been jeopardised from the very start. In 2007, the military junta started the process of negotiating with the Pakistan People’s Party (PPP) and the then Army chief, General Pervez Musharraf, and his trusted associate General Ashfaq Parvez Kayani shaped a power-sharing arrangement with late Prime Minister Benazir Bhutto. The ‘arrangement’ was formalised in the shape of a law—National Reconciliation Ordinance (NRO)—which inter alia intended to drop dozens of cases against PPP’s leadership and politicians. It should be noted that many of these cases were pending in courts for over a decade and due to lack of evidence or faulty prosecution, there were no convictions.

Politicians in Pakistan have faced ‘corruption’ charges since 1950s largely as an instrument to keep them in line and expand the space for the unelected executive i.e. the civil-military bureaucracy, which has ruled Pakistan for the longest period of time in its chequered history. The judiciary historically acted as a subordinate ally of the executive legitimising coups, convicting and debarring politicians and enabling a praetorian state to run the country.

Since 2007, the judiciary has evolved as a powerful institution due to the popular middle-class movement which contributed to the restoration of the deposed Judges and paved the way for Musharraf’s ouster in 2009. Consensus is vital for democracy

 Any morality-led reinterpretation of the supreme law will open doors for future misuse

The federal government seems to have escaped many a crisis in recent months. There is a pattern to this madness. The systemic fault lines of Pakistan’s political system manifest themselves time and again. Whether it is the long-standing civil-military distrust or the fissures within the political elites, this is not a new story. In recent years, the new power centre i.e., higher judiciary has entered the equation thereby creating a new dynamic in terms of power imbalances between various actors. This development has its roots in the events of 2007-2009 when the so-called lawyers movement mobilised urban middle classes and led to what some analysts have termed as the ‘law model’.

Faisal Siddiqui, an active member of the lawyers movement has cited this historic quote in his piece (January 1, 2012,The Dawn) by Justice Jawwad S. Khawaja: “The past three years in the history of Pakistan have been momentous and can be accorded the same historical significance as the events of 1947… and those of 1971 … It is in this backdrop that these petitions have been heard and decided.”

Furthermore, Siddiqui writes how the courts and growing ‘judico-politico’ power articulated the ‘law model’ — negotiating democratic transition through courts and the law — in direct opposition to the ‘force model’ conceived by Musharraf and his associates in the junta. The tensions resulted in the emergence of a ‘consent’ model typified by the NRO and how it allowed for a negotiated democratic transition.

Indeed, this is a new development in Pakistan. The understanding of this law model is rather limited and perhaps rudimentary given that this model is still evolving. Nevertheless, a few conceptual problems can be detected. First of all, it is a well-established principle that democratic development requires an elite consensus of sorts.

The very process of democratisation, as has been noted in various democratic countries entails negotiation, bargain and compromise. Therefore, the consent model is what has driven many countries towards democracy. Several Southeast Asian countries like Indonesia have implemented this model and proceeded with strengthening of civilian institutions.

Needless to say, the political elites and civil society play a major role in effecting this consensus. By signing the charter of democracy, most political parties in Pakistan did agree on a common framework. However, in actual terms the realisation of CoD has been stunted. Even though much of it has been implemented in terms of constitutional reform, the interplay between the parliament, judiciary and the military has been problematic to say the least. (more…)

Pakistan: flood politics at its worst

Flood relief is being used by some as an opportunity to orchestrate political upheaval. Sections of the media are drumming up the partisan politics of a dangerous kind by involving the thorny issue of civil-military relations and the trite-but- failed recipe that the country should revert to authoritarianism whenever a crisis erupts.

Some TV anchors have been overtly suggesting that the military is saving the country at this juncture when the “venal” politicians are staging VVIP visits and not giving any relief. In one TV show, an estranged senator of the ruling party called for martial law. There is now a clear effort to create a duality — that of the military versus the civilian government.

Another charge against the federal government is that of Pakistan’s credibility deficit. The prime cause for this, according to the TV sages, is the president’s tainted persona. The irresponsible statements of the United Nations in terms of Pakistan’s ‘image’ have not helped either. One wonders, in fact, just what evidence the UN has in its possession to reach such a conclusion. Are dozens of developing countries not in the same league? Are corruption and systemic leakages strictly ‘Pakistani’ problems? The UN may investigate this issue and take corrective steps lest it be seen as supporting the forces pitted against democracy in Pakistan. (more…)

Disaster management – which way now?

When the earthquake hit us on the morning of 8th October 2005, we said that the disaster caught us with our pants down. The mini disasters of Cyclone Yemyin in 2007, the Ziarat earthquake in 2008 and the presently unfolding mega disaster suggest that we never bothered to pull our pants up and are continuously trying to cover our nether regions with Post-It stickers. The National Disaster Management Authority (NDMA) was launched in 2007 with a lot of fanfare but a quick look at the (recently lapsed) National Disaster Management Ordinance tells us that it is another toothless tiger whose job is to ‘coordinate’ among its provincial, regional and district-level counterparts. Now, we are a very funny nation. When it comes to taking responsibility for public, we quickly don our ‘federal’ garb and declare that the centre cannot interfere in a job that is primarily provincial/local. Such commitment to federalism, alas, is never forthcoming when it comes to resource exploitation, but that is another story.

NDMA’s mandate can perhaps be classified into three categories: mainstreaming risk-reduction in development programmes, overseeing contingency planning, and coordinating response to disasters.

Before the media promotes NDMA over Zardari and fake-degree holders, as being chiefly responsible for all our woes, it would be pertinent to look at the organization’s capacities and powers. After its establishment, a retired army official was appointed as its head. It took a while before the consultants hired by the United Nations could come up with an organizational structure. But NDMA could not attract the best of professionals chiefly for the work environment. This resulted in NDMA ending up mostly, with pen-pushers. (more…)

Redefining national interest

The elusive quest for peace between India and Pakistan remains hostage to the military-industrial complex at both the global and regional levels. Such is the dynamic unleashed by two imagined “nations” that their existence as states is dependent on a perpetual state of confrontation. More so for Pakistan, given its deeply embedded paranoia, which has assumed a reality of its own. Sixty-two years ago, it was hardly envisioned that the two states would erect an iron-curtain and fight forever. From actual wars to propaganda campaigns the task seems complete now. The oft-repeated phrase ‘trust deficit’ is a natural culmination of this ugly process. Of late, another dimension has been added, i.e. information-deficit as India had marched towards a new phase of its economic development, it has stopped taking interest in transitional Pakistani society and kept the time-warped framework of understanding Pakistan. However, the situation cannot remain static. Policymakers are slow to catch up on both the sides.

Mumbai factor: Twenty months ago, the Mumbai attacks changed the atmosphere created by President Zardari’s unprecedented offers of peace, dialogue and cooperation. The day Zardari made his remarks in a conclave organised by the Hindustan Times in 2008, many observers saw a Mumbai coming. The jihadis of Pakistan and perhaps their counterparts in India were quick to stop this process. Ironic that PPP, a party fed on the Pakistani nationalist rhetoric, thirty years down the road had read the writing on the wall. Pakistan’s future and survival is dependent on a reduction of hostilities with India. More importantly, this also holds the key to correcting the endemic civil-military imbalance. (more…)

Media freedoms versus responsibility (holy cow syndrome)

Much has been said about media accountability and the dire need of a regulation framework for Pakistan’s new power centre. Pakistani media has earned its freedom and independence after a long, often bloody, struggle against military dictators and civilian autocrats. Countless journalists were imprisoned, harassed, even killed in this decade’s long fight for free speech, otherwise a much-touted fundamental right in every Pakistani constitution. There is no question that a viable democracy and a culture of accountability cannot exist without a robust and independent media.

Globalisation and the rise of electronic media in Pakistan, ironically under General Musharraf, is a relatively new phenomenon and has changed the contours of power matrix in the country. If anything, electronic media and its older cousin, the print media, with a plethora of columnists, are now an established group with considerable influence and nuisance value. Actualisation of the newly acquired powers was best demonstrated during the anti-Musharraf movement from 2007-2008. This was a startling development and pleased most Pakistanis as they found the echo of their daily trials and tribulations in the direct and frank reporting by the numerous TV channels.
Ambiguous regulatory framework: The sudden liberalisation of private television channels took place in an environment when a regulatory framework had barely been established. The Pakistani Electronic Media Regulatory Authority (PEMRA) came into existence during an unrepresented regime and, therefore, it lacked the essential process of consultation, ownership, and national consensus. On the one hand, media oligarchies emerged despite the vague announcements that cross ownership would not be permitted. On the other hand, electronic media showed little interest in developing a common code of conduct and finding ways of self-regulation. The results and the initial phase were disasters. Human limbs and heads found ample air time thereby glorifying terrorism and violence, and impacting the collective psychology of the viewers through a gradual process of desensitisation. Furthermore, objectivity was thrown out of the window and partisan, one sided rants became the order of the day.

Lawyers and media alliance: This was a type of intense civil activism and unprecedented representation of the Pakistani middle class in mainstream politics. Seemingly, a momentous development, the foresighted mobilization, came into public domain regurgitating the ‘anti-politics’ biases of Pakistan’s conservative middle class. This automatically resulted in severe distortions of the political expression. The first rule of law was personified by a handful of judges who had been linked to Pakistan’s regressive establishment throughout their careers; and a misconception that rule of law would lead to political, economic, and social transformation became a ‘truth’. Minority voices such as this scribe, alerted to the inherent contradictions of these developments. In short, intra-bourgeoisie struggles could be disruptive but rarely led to transformative social change. The results today are clear. The lawyers are beating up every public official and media representative who attempts to question their activities. After heroic battles the conduct of judges has been called into question. (more…)

Institutions, accountability and the UN Report

The UN Report is a historic document for it brings forth a set of findings and actions that should become the cornerstone for democratic mobilisation in Pakistani politics

The UN fact finding report on Benazir Bhutto’s murder is a scathing indictment of the Pakistani state and its dysfunctional institutions. However, sections of the media have seized it as a glorious opportunity to target the PPP itself by squarely apportioning the blame on Rahman Malik and Babar Awan – the two characters who are now punching-bags of the right wing. Not that Malik or Awan are spotless revolutionaries, but they are no different from the other political actors. After all, Pakistani politics is a nefarious web of patronage, sycophancy and shady deals, often involving the state and its agencies. The reason for targetting these two individuals is simple: they are close associates of President Zardari who, according to the Punjabi urban legends, is the alleged killer of Mohatarma.

Now that the UN report has exonerated Zardari of the crime, a few TV anchors and several writers in the vernacular press are hell-bent on proving that the real reason for Bhutto’s murder was the whisking away of a backup vehicle. Such a narrative ignores the gritty and ugly realities of our polity. The reason is quite clear: public discourse must be shaped in a manner that minimizes the embedded, historical role of the praetorian state, intolerant and suspicious as it is of alternative sources of power. In this case, it would be the popular legitimacy which Benazir Bhutto enjoys even in the grave.

The ‘establishment’

The UN report has attempted at a loose definition of what constitutes the Pakistani establishment, and places its intelligence agencies at the core of such a power-centre. In recent days, this has been derided by the usual suspects. First, the Urdu columnists whose careers have been shaped and enriched by invisible hands. Second, the TV anchors whose shows have lost all credibility. And lastly, the audience they cater to: the conservative mindset which cannot forgive the Bhuttos for being pro-poor, Sindhi and secular. If the parliament and judiciary want to continue exercising their newfound powers, they have no option but to act strictly within the framework of the Pakistani Constitution

Pakistan is a surreal country. Only here we have long, protracted struggles for democracy and only here we are almost always ready to scuttle democracy. Perhaps Iskander Mirza was not all too wrong while making the assessment that democracy does not suit the genius of our people. An added qualification is that it does not suit the genius of the elites, in particular the unelected institutions of the state.

There is now a clear and present danger that the judicial review of the 18th Amendment will lead to a potential clash of the key organs of the state: the legislature and the judiciary. Pundits have also predicted that if such a situation arises, then a logjam will benefit the third force — Pakistan’s well organized formal institution, which is readily available to undertake crisis management. Perhaps such fears are slightly exaggerated and misplaced. But the reality is that Pakistani history teaches us some interesting though unsavoury lessons.

Curse of history

Democracy – the only option

Much has been elaborated on the binding constraints faced by Pakistani democracy. Conventional wisdom suggests that the civil-military imbalance has left little space for democratic institutions to grow and flourish. There can hardly be any disagreement with this point of view. In fact, decades of centralised martial rule have resulted in the militarisation of the society to such an extent that one can hardly discuss anything pertaining to Pakistan without a mention of the Pakistan Army and its role in the country.

There is also a predominant counter narrative in the mainstream discourse. This view holds the impatient and elitist Pakistani politicians responsible for the systemic crash each decade. It stresses that the politicians are adept at undermining the democratic order and it is because of their petty differences and thirst for power that they enter into alliances with the powerful establishment.

The year 2010 is no different as these competing narratives are yet again haunting us. The major breakthrough that was ostensibly achieved with the signing of the Charter of Democracy (CoD) appears to have been diluted at best. In fact, all signs suggest that the mistrust and acrimony of the earlier eras is gradually returning thereby paving the way for another systemic breakdown.

The civilian space reclaimed by the political parties in the year 2008, backed by political mobilisation in that same year was heralded as a new beginning. The elections of 2008 returned the banned parties and their leadership into the legislature, thus defeating a decade of political engineering by general Musharraf and his political and non-political cronies. What happened in the following two years is a question that needs to be addressed. (more…)

We continue to bemoan the failure of democratic norms to take root in our governance culture. True, that the repeated extra-constitutional interventions and direct or indirect military rule have rendered democratic governance as a distant and seemingly unattainable goal. In addition, the emergence of non-state actors, sometimes more powerful than the state itself has also led to formidable and multiple centres of power. In such a milieu, achieving the sustainability of democratic process is a Herculean task. Whilst the intentions of our unelected state institutions and their overt and covert non-state partners are clear, the behaviour of the political elites is confounding.

Not unlike the past, the divisiveness of Pakistan’s political elites has entered into a decisive phase. Fissures are apparent in the post-2008 political accord that led to the unanimous election of the Prime Minister, Yousaf Raza Gilani. The first cleavage, now a recurrent pattern, has emerged in Sindh where the coalition partners — the Pakistan People’s Party (PPP) and the Muttahida Qaumi Movement (MQM) — are pitted against each other for political control of urban Sindh. The latest skirmish is rooted in the evolving arrangements for the local governments and who will end up controlling the third tier of government. However, there is an ethnic dimension to it as well. Karachi remains besieged by sectarian, provincial, and linguistic ghosts that apparently are alive and kicking.

The second disruption in the political compact that led to a transition towards representative rule is unfolding in the shape of a brewing discord between the ruling PPP and the opposition Pakistan Muslim League (Nawaz). The PML-N rules the Punjab and thereby has a stake in the system and power matrix but it is also striving to maintain its ‘opposition’ status. This is why a dual strategy is evident where a few firebrand leaders of PML-N take a hard line against the federal government and the President Asif Ali Zardari. The party does not want to rock the system it says but also considers ‘options’ that lead to a mid-term election or even the premature exit of the President from the office in the wake of Supreme Court rulings on the National Reconciliation Ordinance. Raza Rumi  wonders why we remain in search of a Pakistani identity

Half-truths are what we love to indulge in. One of the countless crimes committed by President Asif Ali Zardari is that he wears a Sindhi cap instead of a Jinnah cap. That by preferring a Sindhi topi and thundering at the occasion of late Benazir Bhutto’s death anniversary, he undermined his Pakistani identity, is truly mystifying. After all, what is a Pakistani identity and why is the Jinnah cap being elevated to the level of an article of national faith?

If anything, Mr Jinnah’s patronage of Muslim identity mark was an afterthought. His usual attire was a well-tailored pucca-sahib-like suit. It was only in the nineteen forties and that too close to India’s independence that Mr Jinnah started donning the Muslim nobility’s attire.

So what is this fuss all about? Constructing Pakistan’s ideology based on theological interpretation of a universal religion like Islam has been a carefully executed project of the Pakistani establishment and its shadows in the non-state domains. Such cliques have grown bigger, mushroomed and are now essential to our lived reality. Therefore lambasting of Zardari on not sporting a Jinnah cap finds public resonance and broad acceptability within the populous Punjab province where the Urdu press flourishes and finds readers and writers aplenty. This night bitten dawn

The triumph of a popular movement on March 16 has marked a new beginning. The retreat of an intransigent government and the wise response by the PML-N and the lawyers averted a major crisis that could have been violent, and also a potential recipe for harming the parliamentary system in its infancy. There was a sigh of relief among the public for a long-standing issue appeared to have been resolved. This has been a monumental achievement by all standards.

However, the inherent imbalances within Pakistan’s power structure and the state of its polity are yet to be addressed and the contradictions of how our power is exercised stared us as the good news rolled out through the ubiquitous TV channels and their zealous presenters. The way quintessentially political issues and turf-wars between the PPP and PML-N were battled and resolved through a stage-managed process only concealed the bitter power-realities of Pakistan. Chronicles foretold

A piece that I wrote with Asad Sayeed for The Friday Times. This piece was written before the long March and the subsequent developments that include the restoration of deposed judges.

The two years old lawyers’ movement is now entering its decisive phase. It started in March 2007 as a spontaneous, vibrant expression of fatigue with a military dictator, after which the lawyers mobilised Pakistan’s inert middle classes and sections of civil society against the arbitrary ouster of the former Chief Justice Iftikhar Chaudhry, and his subsequent maltreatment at the hands of the security agencies. Within weeks, the political parties jumped into the fray and mounted a formidable challenge to an otherwise seemingly well-entrenched military rule. This was a critical year when General Musharraf had assured both the world as well as the nation of a transition to democratic rule. However, Musharraf’s efforts to direct the transition in his favour were forcefully countered by the lawyers through a judicial and political struggle that continues to date. (more…)
