Enigma of democratic governance

Pakistan’s President Iskander Mirza (1956-58) is remarked to have said that democracy was ‘unsuited’ to the genius of Pakistani people. Decades later, similar questions about democratic form of governance are being raised in Pakistan. Take any TV show, multitude of op-eds, or more worryingly, check what the young people have to say on Facebook or Twitter. The parameters of debate remain the same.

The urban Pakistanis’ disdain for the ‘illiterate’, ‘rural’ politicians to rule the country is a running theme. More importantly, the duality of civil-military rule has generated a peculiar discourse: the weak and corrupt ‘civilians’ compromise national security as opposed to authoritarian regimes which guard ‘ideological’ and geographical borders of the country.

This is why we have seen civilian governments come and go, especially in the past two decades with charges of corruption and violation of national security. For instance, Ghulam Ishaq Khan, while dismissing Nawaz Sharif’s government in 1993, alluded to, among others, the charge of murdering General Asif Nawaz Janjua, the Army Chief. Benazir Bhutto till her last remained a ‘security risk’ even when she compromised her principles and fully supported and owned the Taliban policy of the 1990s. The grave sin of Nawaz Shairf in his second tenure was attempting to secure peace with India; and the gravest of all was allegedly plotting to kill the Army chief in 1999 by diverting his flight.

And now the ‘proof’ of this errant and traitorous behaviour is an unsigned memo sent to Americans to contain Pakistan Army. Since the matter is soon going to be subjected to an inquiry and perhaps judicial proceedings, it would be best not to speculate any further than what has been reported, or shall we say, trumpeted in the press. Prior to this, the provisions of Kerry-Lugar-Berman aid legislation (passed by the US Congress) were somehow considered to the handiwork of the civilian government. It eludes commonsense as to how can a civilian government be so powerful to influence a foreign legislature. But then, such tales require a willing suspension of disbelief.

The recent memogate saga, not unlike the past occasions, has accelerated the pace of rumour-mongering and has spurred obituaries of the civilian government. Perhaps even more than the change-rhetoric generated by the October 30 rally of Pakistan Tehreek e Insaaf (PTI) where the memo and its alleged author Pakistan’s former Ambassador to the United States, Husain Haqqani was named in public as an official who may have compromised ‘national interest’. Most media commentators are saying that a change is going to take place before March 2012 Senate elections and the gathering storm of opposition protests (more…)

Governance crisis cannot be treated by old formula of changing faces

Commenting on the melting state of the economy, a reputed economic analyst stated how the “deplorable state of governance” was responsible for the “mismanagement of public goods”. Luckily, he also reiterated how such accountability was best undertaken through an election. A common misnomer that plagues public discourse relates to how “governance” is viewed as the job of an elected government and that the state and the government are interchangeable entities. It is important to note that the state of Pakistan — post-colonial, encroached and bitten by its non-state offspring — remains the dominant power centre and most elected governments have been at subordinate to these permanent interests.

The most glaring manifestation of this reality came about when the federal government in the memo-case (concerning the alleged treasonous act of authoring a memo addressed to the US against Pakistan’s security establishment) submitted before the Supreme Court that it had no control over the operations of the military and the premier spy agency — the Inter Services Intelligence (ISI). This has been said before as well in other judicial proceedings but not so directly. Everyone knew that but the government’s admission makes it clear that ‘constitutional governance’ is but a pipedream in the land of the pure. Without prejudice to any institution, this has been the case for decades and is not going to change overnight.

A new state within the state may have emerged. During the hearing of the same case, an honourbale judge of the Supreme Court remarked in his obiter dicta that the Judiciary was not answerable to anyone but the ‘people’. This statement defies logic as judges are not ‘elected’ by the people; and they are also servants of the state, paid by the taxpayers who are represented by the Parliament. These developments have prompted a beleaguered government and its Prime Minister to announce that Parliament was supreme and that there ‘states within states’ cannot be tolerated.

Leaving aside the torrential decade of 1970s, the evolution of an autonomous power centre within the state apparatus in the form of the intelligence agencies is a well-recognised fact. A martial state since 1950s has been a player in the global power games in the region; and the redirection of state unlike India was almost inevitable. The 2008 elections were, therefore, a transitional moment and during transitions from military to civilian rule, power is shared and not exercised by the elected officials. The addition of another power-centre i.e. the Judiciary is a recent and in its nascent stage of development. Its future course remains unclear whether it can arrest the dominance of the military-intelligence complex. (more…)

Erasing memory to deal with loss – Pakistan, Bangladesh and India

For Pakistan, the worst fallout of the 1971 debacle was excessive militarism resulting from the deep insecurity of the state.

Forty years ago, South Asia underwent another traumatic experience with the Bengali separatist movement in East Pakistan, the India-Pakistan war and the eventual creation of Bangladesh. South Asians are a strange lot. In 1947, the political elites refused to accommodate each other and a hurried, bloody Partition was imposed on millions. Instead of working to undo the harmful effects of 1947, India and Pakistan found themselves entangled in yet another battle. Again this time it was the intransigence of West Pakistani elites to accede to the Bengali demand for autonomy, and India’s short-sighted decision to momentarily ‘benefit’ from its neighbour-enemy’s woes. The jury is still out on whether 1947, and 1971, were avoidable or at least could have been handled in a manner that involved less suffering, and bloodshed.

Tailor-made histories

What has however happened is that three nation states (some say state-nations) now exist with three standing armies, nationalist discourses, honour and of course tailor-made histories.

In Pakistan, a child grows up learning that it was an Indian conspiracy, woven through the Hindu teachers of “East Pakistan” that led to the separatism of the Bangladeshis. For instance, here is a passage from a secondary school textbook: “There were a large number of Hindus in East Pakistan. They had never really accepted Pakistan. A large number of them were teachers in schools and colleges. They continued creating a negative impression among the students. No importance was attached to explaining the ideology of Pakistan to the younger generation. The Hindus sent a substantial part of their earnings to Bharat, thus adversely affecting the economy of the province.” (more…)

Pakistan’s beleaguered civilian government has entered into the final round of its survival game. This is not a new ‘game’ as the transition to democracy has been jeopardised from the very start. In 2007, the military junta started the process of negotiating with the Pakistan People’s Party (PPP) and the then Army chief, General Pervez Musharraf, and his trusted associate General Ashfaq Parvez Kayani shaped a power-sharing arrangement with late Prime Minister Benazir Bhutto. The ‘arrangement’ was formalised in the shape of a law—National Reconciliation Ordinance (NRO)—which inter alia intended to drop dozens of cases against PPP’s leadership and politicians. It should be noted that many of these cases were pending in courts for over a decade and due to lack of evidence or faulty prosecution, there were no convictions.

Politicians in Pakistan have faced ‘corruption’ charges since 1950s largely as an instrument to keep them in line and expand the space for the unelected executive i.e. the civil-military bureaucracy, which has ruled Pakistan for the longest period of time in its chequered history. The judiciary historically acted as a subordinate ally of the executive legitimising coups, convicting and debarring politicians and enabling a praetorian state to run the country.

Since 2007, the judiciary has evolved as a powerful institution due to the popular middle-class movement which contributed to the restoration of the deposed Judges and paved the way for Musharraf’s ouster in 2009. Consensus is vital for democracy

 Any morality-led reinterpretation of the supreme law will open doors for future misuse

The federal government seems to have escaped many a crisis in recent months. There is a pattern to this madness. The systemic fault lines of Pakistan’s political system manifest themselves time and again. Whether it is the long-standing civil-military distrust or the fissures within the political elites, this is not a new story. In recent years, the new power centre i.e., higher judiciary has entered the equation thereby creating a new dynamic in terms of power imbalances between various actors. This development has its roots in the events of 2007-2009 when the so-called lawyers movement mobilised urban middle classes and led to what some analysts have termed as the ‘law model’.

Faisal Siddiqui, an active member of the lawyers movement has cited this historic quote in his piece (January 1, 2012,The Dawn) by Justice Jawwad S. Khawaja: “The past three years in the history of Pakistan have been momentous and can be accorded the same historical significance as the events of 1947… and those of 1971 … It is in this backdrop that these petitions have been heard and decided.”

Furthermore, Siddiqui writes how the courts and growing ‘judico-politico’ power articulated the ‘law model’ — negotiating democratic transition through courts and the law — in direct opposition to the ‘force model’ conceived by Musharraf and his associates in the junta. The tensions resulted in the emergence of a ‘consent’ model typified by the NRO and how it allowed for a negotiated democratic transition.

Indeed, this is a new development in Pakistan. The understanding of this law model is rather limited and perhaps rudimentary given that this model is still evolving. Nevertheless, a few conceptual problems can be detected. First of all, it is a well-established principle that democratic development requires an elite consensus of sorts.

The very process of democratisation, as has been noted in various democratic countries entails negotiation, bargain and compromise. Therefore, the consent model is what has driven many countries towards democracy. Several Southeast Asian countries like Indonesia have implemented this model and proceeded with strengthening of civilian institutions.

Needless to say, the political elites and civil society play a major role in effecting this consensus. By signing the charter of democracy, most political parties in Pakistan did agree on a common framework. However, in actual terms the realisation of CoD has been stunted. Even though much of it has been implemented in terms of constitutional reform, the interplay between the parliament, judiciary and the military has been problematic to say the least. (more…)

This message cheered me up. Amazing that some of us have never met yet there is a bond we share – the calm space in Delhi where a 13th century mystic is buried. I am posting Marta’s letter with her permission below:

Hi Raza Rumi, I wonder if you remember me. Some years back I sent my essay on Hazrat Nizamuddin Aulyia to your site, and you very dearly published it. I had found you on the net, actually I was attracted by your name due to my deep passion and admiration for Mawlana Rumi. But at that time – not a very bright moment of my life, I must say – I didn’t realise who i was sending my message to, neither where. Actually, I discovered only very recently that you really exist, and live and work in Pakistan. Your name appeared in my possible connections in Linkedin, which I joined not long ago thanks to the insistence of a friend. I clicked on your name instinctivly, and later I forgot to go and check your profile and so on. But coincidences are not there for no reason, so few weeks back, while I was travelling with my daughter Sofia in Maharashtra, I read an interesting article on Pakistan on the Hindu, and…there, your name again! Could it be the same Raza Rumi of my essay long time ago? I started to put together the pieces, went back to linkedin, and yes, here you are! Zabardast!

Visitors in the heatI am writing you from my barsati in New delhi, where now I live doing my 2′ year MPhil at JNU in Medieval History. So, you see, the Saint has kept His promise, and brought me back here, after so many years: 24, to be exact. You can probably imagine my overwhemilng joy for such a reunion. Of course, it happened all very “casually”: my daughter went to study in Canada, and I decided to came back to Delhi just for a three months visit. I met so many people, one in particular you may know, Yousuf Saeed of Ektara, who introduced me to Sunil Sharma, who introduced me to Najaf Haider of JNU…I told him about my idea of research, he suggested me to try the admission at JNU. I did. I was accepted, out of every expectation. I packed and moved to my beloved Delhi. This was August 2010, and I was 52 years old. Since then, no matter all the hurdles I had to face, I am the happiest woman of the world. I go to the dargah at least twice a week, but often I end up there also every day. I’d like to tell you more about what has happened inside of me since i came back here – my real home, I feel – and about many other things, and maybe I will do one day, inshallah!

Anyway, I feel the desire to let you know where I am, and what I am doing, and to express you my gratitude for having linked my name to the Saint’s name, when all this was not even imaginable. You brought a real sparkle of light in the dark, at that time. Thank you from the heart, truly.

‘Greater rights’ abuses will ensue unless Pakistan’s elected institutions assert themselves’

Q. HRW has consistently commented on civil-military relations in Pakistan. Why is this aspect of Pakistan’s politics so important for human rights?
Since 2008, Pakistan has made yet another attempt at a transition from direct military rule to rights-respecting constitutional governance. But history teaches us that this moment is as fleeting as it is special. It would be naïve to assume that the 2008 general election has transformed power relations in the country. Pakistan remains a praetorian state structured and geared to service, above all, the needs of a military that remains every bit as convinced as ever that Pakistan’s national interest is synonymous with its institutional priorities and the preservation of its position as the final arbiter of political power and patronage. Indeed, Pakistan’s foreign and national security policies are primarily controlled by the military. In the absence of civilian oversight, and given the military’s history, greater abuses will ensue unless Pakistan’s elected institutions assert themselves.
Q. What are the worrying flashpoints in HRW’s view?
It is hardly a secret that the government and the military are engaged in both a legal and political confrontation over the so-called “Memogate” affair. HRW finds it reassuring that both the Supreme Court Chief Justice and Army chief General Kiyani have ruled out military intervention. Indeed all arms of the state must act within the constitutionally determined ambit and in aid of legitimate civilian rule. In this context, justice must both be done and be seen to be done. Pakistan desperately needs a full democratic cycle and a peaceful transfer of power from one civilian administration to another. Should this process be derailed, the constitutional safeguards and legal rights protections created since 2008 may suffer irreparable damage. (more…)

“Living in today’s Pakistan” – an interview for WPKN

In our wide-ranging interview, Raza spoke eloquently and poignantly about his country and what it is like to be living in Pakistan these days.  Through his lens we can see another Pakistan, a parallel society that has been obscured by the prevailing image of militaristic, unreliable and confusing Pakistan given to us by the mainstream media.

 I have summarized some of the significant points Raza made but I do urge you to listen to him in his own compelling voice.

1. ” Much of Pakistan’s seemingly inextricable alliance with Afghanistan and the Taliban can be explained by its existential fear, “a genuine insecurity” of being encircled by India.  Retaining its ties to the militants is one way of protecting itself from its huge eastern neighbor and as leverage ”in the endgame of Afghanistan.”  (What that endgame will be is “shrouded in mystery…nobody really has a clue of how to approach and how to handle it.”)

2. “The shared geography, history and culture of Khyber Pakhtunkhwa, the continuum between Pakistan and         Afghanistan “makes it very difficult to separate the two.”

3.”Now you have two Talibans, the ones who attack NATO troops and the ones who attack Pakistani people.   Pakistani people want to get rid of the Taliban because their lives have been traumatized…we feel really angry and we’re also suffering…  In this power politics, Afghanistan and Pakistan are burning.” (more…)

Heart to Heart: Remembering Naina Devi

My dear friend Vidya Rao’s labour of love is finally out. She has been working on this project for quite a while. Her book Heart to Heart: Remembering  Naina Devi is a tribute to her teacher, Guru and inspiration who trained Rao as a singer..

Legendary singer, Naina Devi  was born into a Bengali Brahmo Samaj reformist family in the early years of the twentieth century. A childhood replete with music, dance, theatre and social reform gave way to the grandeur and seclusion of the life of a young queen of the Kapurthala royal family of Punjab. Despite seventeen  years of silence necess
itated by the norms of a royal household, she came back to music and a glorious career as a singer, arts-administrator, teacher and patron,  after the tragic death of her husband.

Heart to Heart, traces Naina Devi’s incredible story as she told it to her foremost disciple, Vidya Rao. Naina Devi’s  story traces the changes in the world of Indian classical music, women singers and women in Indian society  over the last century.  Learning seena-ba-seena, heart to heart, in a seamless blend of music and life-lessons,  Rao imbibed not
just a knowledge of her chosen form, Thumri,  but a sense of the very being of her teacher.

The evocative  narrative weaves back and forth between history  and memory,  past and present, and between Naina Devi’s voice and Rao’s own, to illuminate the power  and beauty of music, the lives of these two women and of many others,  of courage, pain, joy and love, and  of the deep bond between Rao and her beloved Guru.

“What the heart is like” – a poem by Miroslav Holub

Today, my friend Khalid Mir told me rather casually that he had been reading poems by Miroslav Holub. I had heard his name; and when K sent me this poem, I could not resist posting it here. Have read it again and again. For sometimes, I tell myself similar lines – of course in a highly unpoetical fashion. Yesterday,  I tweeted this verse from Ghalib: “Meri kismat meiN gham gar itna tha. Dil bhee ya rab kai diye hote“. Indeed many different ways to understand the heart and the one below is unique for its gritty imagery as well as playfulness.

Officially the heart

is oblong, muscular,

and filled with longing.

 

But anyone who has painted the heart knows

that it is also

 

spiked like a star

and sometimes bedraggled

like a stray dog at night

and sometimes powerful

like an archangel’s drum.

 

And sometimes cube-shaped

like a draughtsman’s dream

and sometimes gaily round

More on the Urdu poet Mustafa Zaidi

  I wrote a piece on Urdu poet Mustafa Zaidi six years ago. Since then I have received immense feedback. Zaidi’s relatives, friends and admirers across the globe have contacted me and provided documents, information and related anecdotes. It is all turning into a book of sorts that hopefully will be written one day.

I had mentioned in my post that the cause of Zaidi’s death was shrouded in mystery while most believed that he committed suicide. As I have learnt, the circumstances of his death suggest otherwise. News reports and eyewitness accounts point to the absurdity of the claim that he died in a hotel as family members claim that he was found dead in his own home. Thanks to Zaidi’s ardent fan Abeer Zaidi, I have come to know of more precise facts. I remain grateful for that.

Zaidi, at his time of death had produced several outstanding, original collections of poetry. He was married to a woman of German descent and had two children but his last companion was a woman named Shehnaz, the love of his life. His last five poems titled ‘Shehnaz’  immortalised her. That October day in 1970, Shehnaz was found unconscious along with Zaidi’s dead body.

Following are the circumstances of his demise and the lack of evidence to support the commonly held view that he committed suicide:

On March 20, 1971, under the headline ‘Evidence of Zaidi’s nephew recorded’, the newspaper Dawn reported: “Mr. Shahid Raza, nephew of the former CPS officer and well known poet Mr. S.M. Zaidi yesterday said that there were signs of a struggle having taken place in the room in which his uncle’s body was discovered last October 12. He was testifying in the Court of the District Magistrate, Mr. Kunwar Idris, in the committal trial of Mrs. Shehnaz Saleem, Wife of Mr. Saleem Khan, who is charged with the murder of Mustafa Zaidi.”

The report goes on to say that Mr Raza entered his uncles house with police official and a maternal uncle the morning after his death and found the body lying on the bed. The receiver of the phone was dangling off the hook and the cord stretched across his body. There were stains of blood on his back as well as on the bed sheet and furniture. The room was scattered and a sofa was overturned.

The writer Laurel Steel has mentioned this report in her book, ‘Relocating the Post-Colonial Self’ and has also published some letters written by Zaidi to his wife in Germany to help him get a visa to join his family in Germany. Additionally Steel also mentions that on the day of his death he rose at 8 am and washed his car. Later in the day he received visitors including Shehnaz Gul and afterwards told his servant to go home to return the next morning. The question this must be asked, can this demeanor be that of a man bent on committing suicide in hotel room?

Decades later, this case is still an enigma and has left many of those who appreciated his life and work in denial and doubt.

Dynasties and Clientelism in Pakistan

THE hallmark of Pakistan’s political elites is their narrow base. A limited number of families have dominated Pakistan’s legislatures since the country’s inception in 1947.1 These families traditionally are from rural landowning and tribal backgrounds. The situation in the twenty first century remains largely unchanged. Indeed, the principal change may be the expansion of dynastic politics to include families from urban, religious and military backgrounds.
The politics of kinship networks in Pakistan, as in South Asia more generally, is firmly anchored in the politics of clientelism,2 which in turn is closely related to caste, ethnicity and identity.3 Clan, tribe, caste and biradari4 play a major role in electoral contests and in defining populist politics. These ties also legitimize the political family’s hold on resources and the passing on of these resources as legacy to new generations of family members.

This essay proposes a typology of dynasties in Pakistan, beginning from the ‘traditional’ rural dynasty of the Bhuttos, going on to the urban dynasty of the Sharifs, and concluding with the newer dynasties with religious and military backgrounds. Along the way, it shows how these dynasties are rooted in the politics of patrimonialism and clientelism. (more…)

Disasters, dengue and local government

In the past few weeks, the intractable crisis of governance has once again exposed the dysfunctional nature of the Pakistani state, and its inability to grapple with basic issues of citizenship. After all, the guaranteeing of people’s rights and entitlements is the responsibility of the state, which it simply cannot abdicate. In Sindh, 5.3 million people have been affected by flash floods, out of which 250,000 are now homeless. The floods had been predicted earlier but the provincial and federal authorities were shamefully ill-prepared like last year. In Punjab, over 5,000 people are battling against the dengue epidemic and there are indications that it may spread to other parts of the country.

The killings in Karachi have momentarily halted but as hundreds of citizens were butchered for no fault of their own, the politicians indulged in a macabre game of accusing each other of breaking up Pakistan. Pity that the discourse on Karachi came down to Zulfiqar Mirza versus the MQM and seldom did anyone debate the fundamental causes of ethnic conflict, social breakdown and the governance vacuum. The killings have been followed by the inundation of the megalopolis by heavy rains. The civic failures of Karachi and Lahore on drainage and public health have exposed how cities cannot function without effective, accountable local governments. (more…)

That easy intimacy

As a Pakistani, there is a part of you that reacts instantly to the word Bangladesh: guilt, remorse or, in some cases, nostalgia can suddenly take over. I am from the generation that was spared the horrors of Pakistan Army actions, of information blackouts on the massacre of Bengalis in the name of Pakistani nationalism. But what does it mean to be half a Pakistani, without East Bengal – especially when you know a bit of history and have managed to see through the falsities of the textbooks? It means nothing or it means a lot; it depends on which way you want to look at the other half, now a proud, vibrant country.

Working in international development is what took me to Bangladesh for the first time, nearly five years ago. Prior to that, I had been familiar with the country’s mythical music, rich poetry and tales of its golden sunsets and singing rivers, but had never touched its soil. Bengal’s magic is embedded in the Subcontinental imagination, and these images and literary references long shaped my view of the country. However, my romantic notions were severely jolted when I arrived in Dhaka – at first glance, an overcrowded concrete jungle typically lacking in urban planning. More of the same, I concluded: big cities, despite their buzz, can let you down.

Still, my disappointment did not last, as I soon undertook to seek out the city’s various corners, its hidden spaces of beauty and comfort; above all, what I found was an engaged citizenry marching on. Discovering the University of Dhaka and its surroundings came as a much-needed connection, though older parts of Dhaka are also quite mesmerising. The gulmohar (or krishnachura) trees, almost on fire, greet a visitor on nearly every street, as does a tremendous volume of rickshaws.

Then there is the Shaheed Minar, the monument marking Bengali resistance founded on linguistic identity. The physical monument is modern, and by itself is not particularly exciting. However, its significance is truly monumental, marking as it does Bengali nationalism from 1948 to 1971 under the misrule of West Pakistan elites. Given movements for ethnic, linguistic and provincial identities ongoing in today’s Pakistan, the Shaheed Minar is a powerful reminder of how centralised rule and marginalisation of cultural identities lead to festering problems.

A colleague who took me to see these sites was most polite with me. He was fervently nationalistic but chose his words carefully – at least until I asked him to drop the formalities and just say what he wanted. Then the floodgates opened, and out came his personal memories and renditions from Bengali oral histories. I even found myself apologising, though I then laughed at myself for such a delusional gesture – my few words of apology meant nothing against the horrors of Bengali suffering. Luckily, the charms of the place and the krishnachura trees came to my rescue. And so, I brushed the dark side of our shared histories under the proverbial carpet, just the way that Pakistan has done. For many people in Pakistan, 1971 is today an invisible event, a deliberately ignored footnote in our collective memory, despite being one that should remain understood as a moment of reckoning for the entire country.
